The terms “we”, “us”, and “our” refer to VIM Cosmetics S.R.L. (“the Company”).
VIM Cosmetics operates this online store and website, including all related content, features, tools, products, and services (“the Services”), in order to provide you, the customer, with a curated shopping experience.
Our store is powered by Shopify Inc., which enables us to provide these Services to you.
By visiting or purchasing from our store, you agree to be bound by these Terms of Service (“Terms”) and our Privacy Policy [LINK].
If you do not agree, you should not access or use our Services.
SECTION 1 – ACCESS AND ACCOUNT
By agreeing to these Terms, you represent that you are at least 18 years of age, or that you are using the Services under the supervision and consent of a legal guardian.
You agree to provide accurate, complete, and current information when creating an account or placing an order, and you are responsible for maintaining the confidentiality of your login details.
VIM Cosmetics reserves the right to refuse service or terminate accounts in cases of misuse.
SECTION 2 – OUR PRODUCTS
We make every effort to accurately display product descriptions, colors, and images.
However, actual colors may vary depending on device settings.
All products are subject to availability, and we reserve the right to discontinue or limit quantities at any time.
SECTION 3 – ORDERS
By placing an order, you make an offer to purchase under these Terms.
Orders are accepted once payment has been processed and confirmed.
VIM Cosmetics reserves the right to cancel or refuse any order at its discretion.
Returns and exchanges are governed by our Refund Policy [LINK].
All purchases are intended for personal use and not for resale or export.
SECTION 4 – PRICES, VAT AND PROMOTIONS (EU/RO COMPLIANT)
All prices displayed for customers within the European Union include VAT.
Shipping costs, taxes, or import duties are shown separately before checkout.
Prices, discounts, and promotions are subject to change at any time.
In accordance with EU Directive 98/6/EC (as amended by the Omnibus Directive 2019/2161), when we display a discount, we also indicate the previous lowest price applied in the last 30 days.
SECTION 5 – SHIPPING, DELIVERY AND TRANSFER OF RISK (EU/RO COMPLIANT)
Estimated delivery times are displayed at checkout.
Risk of loss or damage transfers to the consumer only when the goods are physically received by you or a third party indicated by you, in compliance with Directive 2011/83/EU and OUG 34/2014 (Romania).
If you choose your own carrier, not offered by us, the risk passes when the product is handed to that carrier.
VIM Cosmetics delivers throughout the European Union.

SECTION 6 – RIGHT OF WITHDRAWAL (EU/RO COMPLIANT)
You have the right to withdraw from this contract within 14 calendar days without giving any reason, in accordance with Directive 2011/83/EU and Romanian Government Ordinance 34/2014.
The withdrawal period will expire after 14 days from the day you receive the goods.
To exercise this right, send us a clear written statement by email at vim.cosmetics.ro@gmail.com or use the Withdrawal Form [LINK].
Exceptions:
For health protection and hygiene reasons, cosmetic products that have been unsealed after delivery cannot be returned (Art. 16(e) OUG 34/2014).
Refunds will be processed within 14 days of receiving your return, using the same payment method, unless otherwise agreed.
Return shipping costs are borne by the customer unless the product is defective or incorrect.
SECTION 7 – LEGAL GUARANTEE OF CONFORMITY (EU/RO COMPLIANT)
Our products are covered by a two-year legal guarantee of conformity under Directive (EU) 2019/771 and Romanian Law 449/2003.
If the product is defective or not as described, you are entitled to have it repaired, replaced, or refunded.

SECTION 8 – CUSTOMER REVIEWS (EU OMNIBUS COMPLIANCE)
If we publish customer reviews, we clearly indicate whether and how we verify that they originate from real customers (e.g., verified purchase, post-purchase email link).
We do not manipulate or hide negative reviews and clearly mark any sponsored or incentivized reviews.
SECTION 9 – INTELLECTUAL PROPERTY
All content, trademarks, logos, product names, and materials available through the Services are the property of VIM Cosmetics S.R.L. or its licensors.
You may not reproduce, distribute, or modify any part of the Services without written permission.
SECTION 10 – FEEDBACK
By submitting any suggestions, ideas, or feedback, you grant VIM Cosmetics a non-exclusive, perpetual, worldwide, royalty-free license to use such content for improving the Services.
SECTION 11 – ERRORS, INACCURACIES AND OMISSIONS
We reserve the right to correct errors or inaccuracies in pricing, descriptions, or availability at any time without notice, including after orders have been submitted.
SECTION 12 – PROHIBITED USES
You agree not to use the Services for any unlawful or abusive purpose, to transmit malware, or to interfere with the functionality of the website.
SECTION 13 – TERMINATION
We may terminate or suspend your access to the Services at any time if you violate these Terms.
Sections regarding Intellectual Property, Limitation of Liability, Indemnification, and Governing Law shall survive termination.
SECTION 14 – LIMITATION OF LIABILITY
Nothing in these Terms limits or excludes your rights as a consumer under applicable EU or Romanian law.
To the fullest extent permitted by law, VIM Cosmetics shall not be liable for indirect, incidental, or consequential damages.
We do not exclude or limit liability for death, personal injury, fraud, or gross negligence.
SECTION 15 – GOVERNING LAW AND JURISDICTION (EU & ROMANIA)
These Terms shall be governed by and construed in accordance with the laws of Romania and relevant European Union legislation.
Disputes shall be resolved by the competent Romanian courts.

SECTION 16 – LANGUAGE VERSIONS
If these Terms are translated into multiple languages, the Romanian version shall prevail for all sales and disputes within Romania.
